TERMS AND CONDITIONS

Mac Brothers Catering Equipment (Pty) LTD (herein after referred to as Mac Brothers) will only accept written orders and a signed acceptance of quotation schedule subject to:

a) The conditions as set out hereunder

b) The standard terms and conditions as detailed in the credit application form, which must be completed and signed by an authorised signatory of the purchaser.

The original signed documents should be returned timeously to avoid any delays in the processing of the order.


QUOTED PRICES

i All extended prices quoted are strictly nett and no further discount may be applied to the nett prices.

ii Delivery to site where applicable is shown separately

iii Exclude value added tax.

iv Installation labour costs are shown separately

v Quotation valid for 14 days from date of quotation

vi Imported items are at ROE on date of quote and subject to adjustment.


DELIVERY

Based on current factory loading and/or available stock, delivery could be affected within 4 (four) to 8 (eight) working weeks from acceptance of official order. The lead time will be subject to confirmation at time of placement of order and will commence from date of written confirmation having been received by Mac Brothers. Delivery will be made to the ground floor of the building unless otherwise stipulated at the time of enquiry. In instances where specific site dimensions are required before manufacture can commence, delivery dates will be subject to timeous availability of such dimensions from client or as arranged otherwise. Equipment delivered to site must be signed for by client or by his appointed representative in order for us to provide proof of delivery to our insurers in the event of damage and/ or theft on site.


EXCLUSIONS

i Any plumbing work including the connecting up of water services to equipment, supply of stop-cocks, waste fittings and water taps where applicable.

ii Floor drains for equipment where necessary

iii Final electrical connections to equipment including cabling and ancillary fittings

iv Local electrical isolators and main electrical distribution boards

v Remote starting gear and on/off buttons for the extraction equipment unless otherwise stipulated

vi Roof flashing and additional steel work for support of extraction canopies if required unless stipulated.

vii Make-up air supply for extraction canopies unless otherwise quoted.

viii Any building work including making good of existing builder's work and any other trades including painting.

ix Close –off panels between cold/ freezer rooms and ceilings.

x Gas pipe reticulation and gas connections to equipment and pressure regulators.

xi Errors and Omissions Excepted (E&OE)


ACCESS

Reasonable access is to be provided for entry to site and building. Double doors with a minimum width of 1200mm preferred. The dismantling of equipment to pass through narrow doors and passages will be for clients account.


DEFINITIONS

"By Others" means work not contracted by Mac Brothers or its sub-contactors


SITE SERVICES

Electrical power: 230/400 volt 3 phase 50Hz. Permanent power must be in place for commissioning and hand-over of the equipment supplied by Mac Brothers. Potable hot and cold water to be available for commissioning. Minimum pressure 2 bar.


PENALTIES

Penalties for late deliveries outside our direct control will not be accepted


FORCE MAJEURE

Mac Brothers shall not be held liable to perform to the extent and for so long as its performance is prevented, hindered or delayed because of circumstances outside its direct control. Mac Brothers shall give written notice within seven days of the commencement of the force majeure and shall do everything reasonable to remedy the cause quickly.


DEVIATIONS OF SPECIFICATIONS

The quotations are drawn up in accordance with the specifications given or provided through architects drawings etc. Mac Brothers will only agree to changes if these are received timeously and in writing prior to the manufacture of the item/s of equipment requiring a change or modification.

It must be noted that there may be slight variations to dimensions and methods of construction as standard tools and forming equipment will be used for manufacture.

Should the equipment ordered be selected from a Mac Brothers catalogue, it must be borne in mind that design parameters are subject to change without notice to the catalogued items.


ALTERNATIVES

Alternatives, if any are detailed and priced separately (excluding VAT). These prices are not included in the main price column.

GUARANTEE

The guarantee cover applies to all equipment manufactured by Mac Brothers and equipment

supplied by Mac Brothers sourced from approved agencies and installed within the borders of South Africa. The equipment that is exported from South Africa is guaranteed against failure as a result of faulty materials for a period of 12 months commencing from date of dispatch invoice, excluding labour and freight.


SERVICE

This quotation is valid for a period of 7 working days Should this Quotation ( for repairs ) not be accepted within 7 working days the item will be returned unrepaired. A delivery & handling fee will be charged. Payment terms - On spares to be delivered - are strictly COD Proof of payment with quote to be faxed to above details This quotation excludes PARTS REQUIRED AFTER ASSESSMENT ADDITIONAL PARTS REQUIRED TO BE QUOTED ON SEPARATELY QUOTATION EXCLUDES. This quote may include errors and omissions.
